Envirohack Official Rules for Participants

TL;DR Don’t steal, don’t cheat, be nice!

Definitions

The Hackathon being the event running from 18:00 on Friday the 8th November 2019 to 14:00 on Sunday 10th November 2019 at the Digital Jersey Hub, St Helier, Jersey.

The Participants being those who registered to take part in the Hackathon.

The Teams being a group of one or more Participants working together on a Submission.

The Organisers being representatives of Digital Jersey.

The Mentors being those members of industry who have agreed to participate in the Hackathon for the purposes of providing advice and guidance.

The Judges being independent, impartial individuals of high moral character and good standing.

The Sponsors being those who supplied funds for the running of the Hackathon or prizes for the rewarding of Participants in the Hackathon specifically KPMG and Digital Jersey.

The Supporters being those who provided services to enable the Hackathon to take place.

Submissions being a piece of work developed as part of the Hackathon by one or more Participants and submitted for review by the Judges.

The Rules

  1. Conduct and General Conditions
    • All Participants agree to abide by the Code of Conduct as listed at
    • Failure to comply with the Code of Conduct will result in a warning from one of the Organisers or Volunteers.
    • Further breaches of the Code of Conduct will result in expulsion from the Hackathon with no appeal.
    • The Organisers reserve the right to cancel, suspend, and/or modify the Hackathon, or any part of a Hackathon for any reason, including if any fraud, technical failure, or any other factor beyond the Organisers’ reasonable control impairs the integrity or proper functioning of the Hackathon.
    • The Organisers and the Judges reserve the right to disqualify any Participant for the following reasons, as determined by the Organisers at their sole discretion:
      • a Participant has acted, or indicates an intention to act, in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person;
      • the Submission by such Participant contains content including inappropriate or explicit language or images; or
      • the Submission by such Participant is in violation of third-party intellectual property rights, or in violation of applicable laws or regulations.

      a Participant is found to be tampering with (or attempting to tamper with) the entry process or the operation of the Hackathons or the website; a Participant has acted, or indicates an intention to act, in violation of these Rules;

    • If, for any reason, a submission or other information is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the Participant’s sole remedy is another submission to the Hackathon if such submission is practical – saving and backing up work is the Participant’s responsibility at all times.
    • The Organisers will specify a single, official time-keeping device for the Hackathon.
    • The Organisers’ failure, one or more times, to enforce any provision of these Rules will not prevent the Organisers from later enforcing that provision (i.e., will not constitute a waiver of that provision).  These Rules contain the entire agreement between the parties relating to the Hackathon, and no amendment or modification of these Rules will be valid unless in a writing signed by the Organisers.
    • Should any provision of these Rules be held to be void, invalid or inoperative, the remaining provisions will continue in effect and the invalid provision will be deemed modified to the least degree necessary to remedy such invalidity.
    • In the event that there is an ambiguity, discrepancy or inconsistency between these Rules and any other disclosures or other statements, whether written or oral, contained in any Hackathon-related materials or made at a Hackathon, it will be resolved at the Organisers’ sole discretion.
    • Participants are responsible for obtaining all required approvals, consents and authorizations, if any, that may be required in order for them to participate in a Hackathon and make a Submission for final judging, including approvals, consents and authorizations that may be required from their employer.
    • Alcohol will not be provided by the Organisers nor is it permitted on the premises of the Hackathon.
    • Drunkenness and/or intoxication will not be tolerated and will result in disqualification from the Hackathon.
    • Any illegal substances or materials are strictly prohibited and any participant shown to be in possession of such will be disqualified and reported to the local police.
  2. Work Timeline, Prior Work and Remote / External Work
    • Participants will have from 18:00 on Friday 8th November 2019 until 12:00 on Sunday 10th November 2019 to work on their Submission(s).
    • No code may be written as part of a submission prior to the start date above.
    • Plans, designs, wireframes and research prior to the start date is permitted.
    • Original work conducted by parties who are not registered Participants of the Hackathon and / or by those who are registered Participants but have not been physically present at the Hackathon for any time during the event is not permitted.
    • Remote work (i.e. work conducted by Participants not on the premises of the Hackathon) is permitted but only in the event that the Participant have previously been present at the premises for a period of not less than 6 hours during the Hackathon itself.
  3. Submissions
    • Any submission must be related to the topics of the Internet of Things and Data Services.
    • Submissions must be made by 12:00 on Sunday 10th November 2019 in order to be eligible for judging.
    • Submissions are made by completion of the lighting pitch (up to 5 minutes maximum), submission questionnaire and provision of code, a demo, prototype or other version of the Submission to the Judges.
    • Participants should also ensure they or a representative from their Team is available to answer any follow up queries from the Judges after the work has been submitted.
    • Any Submission that is not in compliance with the requirements laid out on the questionnaire will be deemed ineligible and will not be considered in the final judging.
    • Submissions may not contain any content that:
      • is inappropriate, offensive, or which does not relate to the subject matter of the Hackathon;
      • infringes any third-party intellectual property rights, such as if the content contains trademarks or logos owned by third parties or copyrighted materials (unless written permission is obtained);
      • constitutes advertising content;
      • contains any personal identifying information (such as names, telephone numbers, or street addresses); or
      • violates any applicable law.

4. Libraries, APIs & Third-Party Components

    • The use of 3rd party libraries, APIs and or other software components authored or developed outside of the Hackathon is permitted and encouraged.
    • Any library, API or software included must have existed in a useable form prior to 1st August 2019.
    • In the event that a library, API or component was initially developed after this date it may still be used if it can be clearly demonstrated that the software or services was not developed by any hackathon Participant or for the purposes of the Hackathon.
    • All Libraries, APIs and other components must be declared as part of the submission process. This includes traditional software libraries as well as any front-end libraries (e.g. in the case of a web project jQuery).
    • Standard runtime features do not need to be declared separately from the technology used declaration.
    • Failure to declare a library may render a submission invalid.

5. Prizes

  • The first prize shall be the KPMG Prize for IoT Excellence and will constitute and award of GBP to the value of £2,000.00 (two thousand pounds).
  • The second prize will constitute and award of GBP to the value of £600 (six hundred pounds).
  • The third prize will constitute and award of GBP to the value of £400 (four hundred pounds).
  • Winning Teams or Participants must ensure they can provide photographic identification for the purposes of fulfilling KYC requirements.
  • All winners are subject to verification by the Organisers, whose decisions (at their sole discretion) are final and binding in all matters related to the Hackathon.
  • Winners will be notified at the Hackathon at the time of judging.  The “Team Leader” is required to be present at the time of judging in order to be eligible to collect the prize.
  • If a Hackathon winner (or, if applicable, each member of the winning Team) cannot be contacted, fails to provide the required KYC documentation (if applicable), or if the notification is returned as undeliverable, the Hackathon winner forfeits his or her prize.
  • If a Hackathon winner (or, if applicable, each member of the winning Team) is disqualified for any reason, the Organisers may name an alternate Participant who had the highest score among the remaining eligible entries as the winner.
  • All decisions regarding prize awards are final and binding, and no more than the stated number of prizes will be awarded.
  • Prizes are non-transferable by the winner, except as may be shared among the members of a winning Team.
  • Only one (1) prize per winning Team will be awarded.
  • If a Participant accepts a prize, such Participant will be solely responsible for determining and paying all related applicable taxes.

6. Intellectual Property Rights

    • Participants must create Submissions using technology, data, and intellectual property that they have permission to use.
    • This could mean that Participants create the software or technology, acquired ownership of the rights from a third party, or received the express (i.e. written) permission of the third party that owns or has the right to license the intellectual property.
    • Participants may not make a Submission that contains content that is copyrighted, protected by trade secret, or is otherwise subject to third party intellectual property rights or other proprietary rights, including privacy and publicity rights, unless they are either the owner of such rights or have obtained written permission from the owner to use and post such content.
    • By making a Submission or accepting any prize, Participants represent and warrant that the Submission submitted complies with the requirements of this paragraph.
    • Any Participant who violates this provision will be disqualified from the Hackathon.
    • Participants should consult with appropriate advisors or legal counsel if they have any doubt as to whether they are meeting the requirements of this section (i.e., by reviewing appropriate intellectual property filings, notices, etc. of the third parties that are granting them licenses).
    • If Participants are working as a Team, the Team is responsible for determining the ownership as between the Team members of any intellectual property rights in and to the Submission and any material developed during a Hackathon.
    • Neither the Organisers nor the Judges will be responsible for any disputes among members of a Team, including in connection with intellectual property ownership issues.
    • If there are any doubts about the legal status of Participants intellectual property or third-party intellectual property, Participants should seek independent legal advice.
    • All Submissions by Participants, and the intellectual property rights in any such Submissions, will remain the property of the submitting Participants.

7. Mentors

  • The Organisers may, in their sole discretion, make available to Hackathon Participants floating Mentors who will assist during the Hackathon.
  • Any conversations or materials shared with a Mentor during the Hackathon will be considered public and not subject to confidentiality obligations.
  • Participants acknowledge that they should seek independent legal counsel to resolve any questions that they may have about the foregoing.

8. LIMITATION OF LIABILITY AND RELEASE

    • By participating in a Hackathon, Participants agree to each of the following:
      1. to comply with and be bound by these Rules and the decisions of the Organisers and/or the Judges, which are binding and final in all matters relating to the Hackathon, including interpretation of these Rules and awarding of prizes; and
      2. to release and hold harmless the Organisers, Judges and their parent, subsidiary, and affiliated companies, officers, contractors, subcontractors and any other organizations involved in sponsoring, fulfilling, administering, advertising, or promoting the Hackathon, including the Sponsors, and all of their respective past and present officers, directors, employees, agents, and representatives, as well as the Mentors (collectively, the “Released Parties“) from and against any and all losses, damages, costs, expenses, liability, and claims of any kind, including, but not limited to, any injury, death, damage, loss of property, revenue, or profits, negligence, invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye, or any other legal theory), defamation, slander, libel, violation of right of publicity, misappropriation of trade secrets, infringement of trademark, copyright or other intellectual property rights, in each case whether direct, indirect, or consequential, arising out of or relating to any creation or submission, participation in the Hackathon (including any travel or activity related thereto), acceptance or use or misuse of any prize (including any activity related thereto), and/or the broadcast, transmission, performance, exploitation, or use of their submission.
    • Without limitation of the above, the Released Parties are not responsible for:
      1. any incorrect or inaccurate information, whether or not caused by Participants, printing errors, or by any of the equipment or programming associated with or utilized in the Hackathon;
      2. technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in electrical power, internet lines or network hardware or software;
      3. human intervention in any part of the entry process or the Hackathon;
      4. technical or human error that may occur in the administration of the Hackathon or the processing of entries; or
      5. any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from participation in the Hackathon or receipt, use, or misuse of any prize.
    • Participants agree to indemnify, defend, and hold harmless the Organisers from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to violation of third party intellectual property rights as a result of their participation in a Hackathon or submission.

9. NO WARRANTY
THE ORGANISERS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE HACKATHON, WHETHER EXPRESS OR IMPLIED.  IN NO EVENT SHALL THE ORGANISERS, THEIR DIRECTORS, OFFICERS, EMPLOYEES, THE JUDGES, ANY MENTORS PRESENT AT THE HACKATHON ON BEHALF OF THE ORGANISERS AND ANY AFFILIATES OF ANY OF THE FOREGOING BE LIABLE FOR ANY ADVICE, INFORMATION, OR DECISIONS MADE FOR OR ON BEHALF OF THE ORGANISERS OR FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING ECONOMIC DAMAGES OR INJURY TO PROPERTY AND LOST PROFITS, REGARDLESS OF WHETHER THE ORGANISERS HAVE BEEN ADVISED, HAVE OTHER REASON TO KNOW, OR IN FACT WILL KNOW, OF THE POSSIBILITY OF THE FOREGOING, EXCEPT AS ARISES FROM THE FRAUD OR WILLFUL MISCONDUCT OF THE ORGANISERS
